KDA Proposes Increases to Seed Dealer Registration Fees
During the 2026 legislative session, the Kansas Legislature passed Senate Bill 425, amending K.S.A. 2-1421a to increase the statutory fee caps for retail and wholesale seed dealer registrations. The legislation raised the maximum registration fee from $30 to $50 for retail seed dealers and from $250 to $400 for wholesale seed dealers. These fees had not been increased in many years.
Following passage of SB 425, the Kansas Department of Agriculture (KDA) published proposed amendments to its regulations and a notice of public hearing. The proposed regulations would increase registration fees to $40 per retail location, $330 per wholesale location and $370 for each location where a business operates as both a retail and wholesale seed dealer.
Proposed Registration Fees
| Registration Type | Proposed Fee |
|---|---|
| Retail seed dealer | $40 per location |
| Wholesale seed dealer | $330 per location |
| Retail and wholesale seed dealer | $370 per location |
Proposed Regulatory Changes
The proposed amendment to K.A.R. 4-2-21 would increase the current retail seed dealer registration fee from $30 to $40 and the current wholesale seed dealer registration fee from $250 to $330.
KDA estimates the proposed changes would generate an additional $41,560 in revenue. According to the department, the additional revenue would cover seed inspection costs while maintaining the current level and frequency of inspections, without requiring those costs to be subsidized by other funds.
The proposed increases would affect individuals and companies selling agricultural seed.
The department is proposing to increase registration fees by 33% rather than raising them to the new, higher statutory caps established by SB 425.
